Terms & Conditions of Hire

Definitions:

Function = any event, party, wedding reception, club/corporate/commercial event or any organised entertainment.

DJ = Us, we, NikNat Entertainment, hired DJs, DJ

Client – you, hirer, function coordinator, event manager, club management

We require a minimum of $300 deposit to give you a confirmed booking for your function unless agreed otherwise.

Full payment must be made 14 days prior to the commencement of the function. (Find the agreed date on your tax invoice).

Any notified changes must be made at least 28 days prior to the date of the event or as agreed.

Cancellation of your event must be made 60 days prior to the date of the event or as agreed. If you fail to cancel your booking before the agreed date, you could be charged with a cancellation fee.

Booking deposits are non refundable unless NikNat Entertainment are unable to fulfil the service due to circumstances out of our control.

Paying a booking deposit for your event or function is a 100% binding guarantee of contract and your agreement to these Terms and Conditions.

Any non payment of a deposit allows us to take other bookings without prior notice.

Payment of any fees additional to the contract amount must be paid within 7 days after the date of the event.

It is the responsibility of the hirer and the venue to ensure that there is adequate provision of clean electrical power within ten metres of our set-up point. We require a minimum of 2 x 10 amp outlets (normal power points) dedicated purely for our equipment. The power points will be checked with a self-testing voltage detector for any faults before our equipment will be plugged in. Any damage caused to our equipment by and inadequate power supply or power interruption is the responsibility of the hirer; the hirer/client is fully responsible for any damage caused to the equipment caused by the use of noise limiters and the subsequent cut off and reintroduction of power without our consultation.

In the event of an outdoor event, it is the hirers responsibility to ensure the DJ has cover from the sun and rain. The DJ reserves the right to cease performance if he/she deems any danger to be present due to weather conditions.

All bookings should be taken on the understand that the venue is in possession of the necessary entertainment and liquor licenses. We are not responsible if the venue is found to be in breach of the terms of their license.

The DJ and any assistants will conduct themselves in a proper manner throughout their attendance at the venue and will respond to the venue managements request in relation to volume, positioning of equipment and any other reasonable requests when possible. We will not be liable for non-fulfilment of this contract as a result of the venue management’s requests and directions, however every reasonable precaution will be taken. In the event of the client seeking compensation, we will not be liable under any such claim, and the performing DJ will only be liable for a sum up to and not exceeding the contracted amount paid directly to them.

The hirer is responsible for any damage to our equipment caused by any person at your event. You will be charged for the full cost of any repairs / replacement and expenses incurred during the repair period. You will be advised of any damage as soon as it is caused and notified of the repair cost as soon as possible.

We do not tolerate violent, aggressive or abusive behaviour from anyone under any circumstances and reserve the right to leave if we feel unsafe at any time.

We take music requests within reason. Your requirements for your music will be arranged with NikNat Entertainment before the event as to what you will want played and not want played.

Final confirmation of all details (including song selection and choices) are required 14 days prior to your booked date. Any changes or additions after this date may not be guaranteed. Failure to advise NikNat Entertainment of these details (song choices, required Master of Ceremony details, timeline etc) will result in our professional selection of details for you.

In the event of a fire, flooding, public disturbance, terrorist activity or any other threat to the public, we will not be responsible to help in any way or evacuate any venue or guiding where we are present and/or working within, unless the emergency regulations for the venue specify otherwise.

We require access to the performance area a minimum of two hours prior to our start time and one hour allowance at the end of the night to pack up. This time can be reduced if access is good and we are familiar with the venue.

If you are booking any other entertainment (eg. singer, comedian, band, dancers etc) in addition to ourselves, please consider the amount of space available and where you are going to place the dance floor. Speaker location is usually best if it is no greater than 10 metres either side from the position of the presenter. Any additional booked entertainment must contact us a minimum of 14 days prior to the event so that we can assess if they require anything from us.

We require sufficient floor space which would allow the audio and lighting equipment to be assembled safely.

We reserve the right to substitute alternative entertainment should uncontrollable circumstances dictate the need to do so.

Absolutely no liquids or fire hazards are to be placed on the DJ/performers table or equipment provided before, during and after the performance.

Bubble machines, Low lying fog machines and Lights are available for hire; and as they are electrical items must not be touched by clients for safety reasons.

A wireless microphone is supplied for speeches only.

One main meal is to be supplied as the entertainer normally works a minimum of nine hours on the day without a break.

We will not be responsible for any damage or loss to private or public property caused by invited or uninvited guests.

All equipment used is checked prior to arrival and has been fully tested for safety by a qualified electrician. If we are linking our equipment within a fixed in-house audio system, we reserve the right to refuse to do so if the equipment is considered to be unsafe or liable to cause damage to any component linked to it. The hirer is liable if post inspections prove that damage has been caused by faulty equipment other than ours.

We reserve the right to alter any or all of the above terms and conditions at any time. Adequate notice will be provided to clients who have already booked our services.

The terms and conditions take effect as soon as the client is informed that their booking status is “confirmed”and the agreed deposit has been paid. If the client has issues with any of the items in the terms and conditions, please contact us immediately otherwise we assume that the client has read, acknowledged and agreed to all the terms and conditions as stated.
